Terms of service
English translation
Provided for convenience. In case of any discrepancy the Czech version prevails (art. 15.4).
Article 1 — Who we are and what these terms cover
1.1. The service provider is Tengo, s.r.o., company ID 03339165, VAT ID CZ03339165, registered office Dolní Valy 205, 262 72 Březnice, Czech Republic, registered in the Commercial Register kept by the Municipal Court in Prague, section C, file 230360 (the "provider" or "we"). We provide the services under the killBottleneck brand.
1.2. These terms of service (the "terms") govern the provision of the hosted services of the killBottleneck application — i.e. running the application on our infrastructure and our AI service. They do not apply to running the application free of charge on your own server (self-hosting); that is governed by the Sustainable Use License published with the source code (the LICENSE file).
1.3. The customer (the "customer" or "you") is a business or a consumer who orders a hosted service from us. The terms are written primarily for businesses (B2B); special rules for consumers are in article 12.
1.4. Contacts: general enquiries info@killbottleneck.com, support support@killbottleneck.com, security security@killbottleneck.com, licensing licence@killbottleneck.com.
Article 2 — What we provide (subject of the service)
2.1. The hosted services are:
| Service | What it includes | Billing period |
|---|---|---|
| Trial | Your instance free for 30 days, for the whole team (we do not limit the number of users; AI has a smaller quota). After it ends the instance switches to read-only mode (see art. 11.6); the data remain and can be exported. | free |
| KB Cloud Lite | Your instance in an isolated container on our shared server: own address (subdomain), HTTPS, updates, daily backups, AI service included (basic quota per instance). We do not limit the number of users; capacity is determined by the shared machine and the AI quota. Task attachments by link only — we do not upload third-party files to our server. Self-service plan: help and documentation are available, individual support is not. | quarterly or yearly |
| KB Cloud Pro | Your own virtual server — separate data and performance, task attachments up to 5 GB, AI service included (higher quota), e-mail support. Includes the n8n tool as your own instance on your server (we install it and maintain the server environment; we do not manage the content of your workflows; n8n AI features use your own AI account). We do not limit the number of users; capacity is determined by the machine. | monthly |
| KB Cloud AI Agent | Everything in KB Cloud Pro on a stronger machine, plus the Hermes agent that works tasks from your maps. The agent and n8n use your own AI account (API key) — our AI service covers only the features inside the killBottleneck application. Priority e-mail support. A stronger machine or an optional availability agreement (SLA, art. 5.3) can be arranged for plans with a dedicated server at an extra charge. | monthly |
2.1.1. Current prices and plan parameters are published at killbottleneck.com/pricing. The price valid at the time of the order applies. The scope of the AI service is governed by article 9.
2.2. We run the application on Hetzner servers in Germany (EU). The AI service (AI feature computations) runs on the provider's hardware in the Czech Republic or at our supplier AKI.IO GmbH in Germany (EU) — always within the EU, without retaining content and without training on your data. Details of data processing are in the Data processing agreement (annex to these terms) and the Privacy policy.
2.3. The killBottleneck software itself is provided under the Sustainable Use License; these terms do not grant you any additional licence rights to the software beyond that licence.
Article 3 — Ordering and conclusion of the contract
3.1. You order the service via the order form at killbottleneck.com / killbottleneck.cz and payment through the Stripe payment gateway, or by individual agreement by e-mail (especially for stronger machines and SLA).
3.2. The contract is concluded when we confirm your order by e-mail after the payment has been received. Until then we are not obliged to set up the service.
3.3. We set up the instance within 24 hours of the conclusion of the contract; it is usually ready within a few minutes.
3.4. We reserve the right to refuse an order (e.g. on suspicion of abuse or for requests we cannot cover in terms of capacity); in that case we refund the amount paid.
Article 4 — Prices and payments
4.1. Service prices are listed in the price list at killbottleneck.com/pricing valid on the day of the order. The price of a stronger machine and of the optional availability agreement (SLA) is agreed individually according to the size of the machine and the team.
4.2. Payments are made through the Stripe payment gateway — by payment card or other methods offered by Stripe. The Cloud Lite plan is paid quarterly or yearly in advance; plans with a dedicated server (KB Cloud Pro, KB Cloud AI Agent) monthly in advance.
4.3. The subscription renews automatically for the next period unless you cancel it no later than 7 days before the end of the current period. We inform you of the upcoming renewal by e-mail in advance. You can cancel the subscription at any time — cancellation stops further renewals, the paid period runs to its end and the service works until then.
4.4. We issue the tax document (invoice) and send it by e-mail after receiving the payment.
4.5. We announce changes to the price list at least 30 days in advance. For a running subscription the new price applies only from the next billing period; if you do not agree with it, you can cancel the service as of the renewal date.
Article 5 — Service availability
5.1. We operate the service with professional care on a "best effort" basis — we aim for uninterrupted operation, but for the KB Cloud Lite, KB Cloud Pro and KB Cloud AI Agent plans we do not guarantee a specific availability percentage (SLA) and an outage does not give rise to a claim for a discount or compensation beyond article 10.
5.2. We try to carry out planned maintenance that interrupts the service outside normal working hours and announce longer outages by e-mail in advance.
5.3. For plans with a dedicated server (KB Cloud Pro, KB Cloud AI Agent) an optional availability agreement (SLA) can be arranged individually at an extra charge: guaranteed availability of 99.5 % per month and, if not met, a credit equal to a proportional discount on the monthly price. The SLA covers service availability only; it does not guarantee support response times.
5.4. Availability does not include outages caused by force majeure, defects on the side of third parties beyond our control (backbone connectivity, Hetzner, Cloudflare, Stripe), the customer's intervention or planned maintenance.
Article 6 — Support
6.1. We provide support by e-mail at support@killbottleneck.com, in Czech and English.
6.2. We answer enquiries during normal working hours; with priority for the KB Cloud AI Agent plan. We do not guarantee a response time — support is provided within our operational capacity.
6.3. Support covers help with operating the hosted service. It does not cover consulting on your own self-hosting, custom modifications or training — these can be arranged separately.
Article 7 — Customer obligations
7.1. You may use the service only in accordance with the law. In particular, you must not store content in the instance that infringes the rights of third parties or the law, nor use the service to send spam, carry out attacks or distribute malicious code.
7.2. You must not resell the service or provide it to third parties as your own hosted service — that conflicts with the Sustainable Use License. Making the instance available to your own team, collaborators and guests within your organisation is of course fine. Those interested in a commercial licence (hosting for third parties, white-label, resale) write to licence@killbottleneck.com.
7.3. You are responsible for the content you and your users put into the instance and for having the necessary permissions to process it (for personal data see the Data processing agreement).
7.4. Protect your access credentials. Report suspected account abuse or a security incident without delay to security@killbottleneck.com.
7.5. You must not attempt to circumvent the technical limits of the service (AI quotas, plan limits, instance isolation) or disrupt the operation of the infrastructure.
7.6. In the event of a serious or repeated breach of this article we may suspend the service after prior notice; if you do not remedy the breach within 14 days, we may terminate the contract without compensation. In the event of an acute threat to operations or legality (e.g. distribution of malware) we may suspend the instance immediately.
Article 8 — Customer data and backups
8.1. All content you put into the instance (maps, tasks, comments, time entries, e-mails of your users) is yours — we acquire no rights to it beyond what is necessary to operate the service.
8.2. Instances are isolated from each other (a separate container for Cloud Lite, a separate virtual server for plans with a dedicated server). The content of your maps is never stored in the AI service logs — this is our binding operating principle.
8.3. We back up data daily; backups are stored off the host server (off-site, in the EU). Backups serve to restore operations after a failure; we do not guarantee restoration of individual deleted items on request.
8.4. At any time during the contract you can request an export of your data (PocketBase database backup); for the self-manageable parts you can also make it yourself in the application.
Article 9 — AI service
9.1. We provide AI features within fair use and our operational capacity; we do not guarantee a specific number of requests. In the event of excessive use we may limit the AI features or suspend them until the end of the billing period — the other features keep running. The trial has a smaller, fixed quota of AI requests for trying it out.
9.2. AI outputs are machine-generated and advisory in nature — verify them before an important decision. We bear no liability for the content of AI outputs beyond article 10.
Article 10 — Limitation of liability
10.1. We provide the service "as is" within the described parameters. To the extent permitted by law, we are not liable for lost profit, loss of data beyond our backups, indirect and consequential damage.
10.2. Total compensation for damage under one contract is limited to the amount you have paid us for the service in the 12 months preceding the occurrence of the damage.
10.3. The limitations in this article do not apply where the law excludes them — in particular for damage caused intentionally or by gross negligence, for personal injury and towards a consumer to the extent that liability towards them cannot be validly excluded.
Article 11 — Term, termination and data export
11.1. The contract is concluded for the prepaid period and renews under art. 4.3.
11.2. The customer may cancel the subscription at any time with effect from the end of the current prepaid period (in the Stripe account or by e-mail to support@). The payment for the unused part of the period is not refunded unless the law provides otherwise (for consumers see art. 12).
11.3. We may terminate the contract with a notice period of 3 months, at the earliest as of the end of the prepaid period — e.g. when discontinuing the service. In that case we refund a proportional part of the price for the unused period.
11.4. Data export on termination: when the service is cancelled we provide you with an export of your data (PocketBase database backup). It is available for download for the whole data retention period under art. 11.5 — 90 days for paid plans, 30 days from the end for the trial.
11.5. Retention and deletion of data after the contract ends: after a paid contract ends we keep the instance data for a further 90 days — if you renew the plan within that time, the instance is unlocked with all data at the same address. After 90 days we delete the data; copies in rotating backups expire no later than the end of the backup cycle (currently 14 days of local retention, i.e. complete removal within approx. 105 days). At your express request we delete the data earlier.
11.6. Trial and read-only mode. We provide the trial for 30 days free of charge and without the need to enter a payment card. After it ends the instance does not cease to exist and the data are not deleted — it switches to read-only mode: logging in, browsing and exporting data continue to work, but content cannot be created or edited. By ordering a paid plan the same instance is unlocked with all data at the same address. We delete an unused trial instance and its data 30 days after the end of the trial period; we give notice by e-mail beforehand.
Article 12 — Provisions for consumers
12.1. This article applies if you are a consumer (a person ordering outside the scope of their business).
12.2. Withdrawal within 14 days: you may withdraw from a contract concluded online within 14 days of its conclusion without giving a reason, by e-mail to info@killbottleneck.com (you may use the model form below).
12.3. Start of performance before the withdrawal period ends: the service is set up shortly after payment. In the order you therefore expressly request that the provision of the service begins before the withdrawal period expires and acknowledge that if you withdraw, you will pay a proportional part of the price for the period up to the withdrawal; if the service has been provided in full by then, the right of withdrawal ceases.
12.4. Complaints are handled within 30 days; they are made to support@killbottleneck.com.
12.5. Out-of-court dispute resolution: the body for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (coi.cz).
12.6. Model withdrawal form: "To: Tengo s.r.o., Dolní Valy 205, 262 72 Březnice, info@killbottleneck.com. I hereby give notice that I withdraw from the contract for the provision of the killBottleneck service ordered on …, name and surname …, account e-mail …, date, signature (if sent on paper)."
Article 13 — Changes to the terms
13.1. We may change these terms to a reasonable extent (changes to the service, laws, infrastructure). We announce a change by e-mail at least 30 days before it takes effect.
13.2. If you do not agree with the change, you may terminate the contract up to the effective date of the change with effect as of that date; we refund a proportional part of the price for the unused prepaid period. Otherwise you accept the change by continuing to use the service.
Article 14 — Personal data protection and data processing agreement
14.1. The processing of personal data where we are the controller (your account, invoicing, operational logs) is described in the Privacy policy on the website.
14.2. For the content of your instance we are the processor — an integral part of the contract is the Data processing agreement (DPA), which forms annex no. 1 to these terms.
Article 15 — Final provisions
15.1. The contract and these terms are governed by the law of the Czech Republic. The UN Convention on Contracts for the International Sale of Goods does not apply.
15.2. The courts of the Czech Republic have jurisdiction over disputes with businesses; the locally competent court is the court of the provider's registered office. The rights of consumers under the law of their place of residence in the EU remain unaffected.
15.3. If any provision is invalid, the remaining provisions remain in force.
15.4. In the event of a conflict between the language versions of these terms, the Czech version prevails.
15.5. Effective from: 8 August 2026.
